1. Acceptance of Terms

By accessing and using ICEShare ("the Service"), operated at iceshare.peebee.com.au, you accept and agree to be bound by the terms and conditions of this agreement. If you do not agree to these terms, please do not use the Service.

2. Description of Service

ICEShare provides a secure emergency access sharing system that allows users to share sensitive information with designated trustees. The information is encrypted, stored securely, and can be accessed one time only by the designated trustee.

Educational Purpose: This project demonstrates cryptographic techniques including envelope encryption, key management with HashiCorp Vault, and secure one-time access mechanisms. It is shared publicly to help others learn about security engineering.

3. User Responsibilities

3.1 Appropriate Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

Use the Service to share illegal content or information
Share information you do not have the right to share
Attempt to gain unauthorized access to the Service or its systems
Use the Service to transmit malware or harmful code
Abuse, harass, threaten, or intimidate other users
Attempt to circumvent security measures
Use automated systems to access the Service without permission

3.2 Account Security

You are responsible for:

Maintaining the confidentiality of management links provided to you
Ensuring email addresses provided are accurate and accessible
Choosing trustees carefully and ensuring they understand their responsibility
Revoking access if circumstances change
Maintaining your own backups of critical information

4. Service Limitations & Disclaimers

4.1 One-Time Access

Once a trustee accesses the shared information, it is permanently and irreversibly deleted. We cannot recover this information. You should maintain your own backup of any critical information.

4.2 Expiration

Shares expire after 1 year if not accessed. While we send reminder emails, you are responsible for managing expiration and extending shares as needed.

4.3 Service Availability

Best-Effort Availability

As a personal project, this service has NO guaranteed uptime or availability. The service may experience downtime for maintenance, updates, hosting issues, or may be discontinued at any time with or without notice. We are not liable for any downtime or data loss.

4.4 No Professional Support

This is not a commercial service. Support is provided on a best-effort basis with no guaranteed response times. There is no SLA (Service Level Agreement).

5. Privacy and Data Protection

Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

6. Security

6.1 Our Commitment

We implement industry-standard security measures including:

End-to-end encryption using XSalsa20-Poly1305
Key management via HashiCorp Vault
TLS/SSL for all communications
Regular security updates
Rate limiting and abuse prevention

6.2 No Absolute Security

Security Disclaimer

While we implement strong security measures, no system is completely secure. This is a personal project that has not undergone professional security audits. You use the Service at your own risk and should not share information whose compromise would cause catastrophic harm.

7. Intellectual Property

The Service, including its original content, features, and functionality, is owned by PIPSCOMPUTERS PTY LTD and is protected by international copyright, trademark, and other intellectual property laws. The source code and architecture are shared for educational purposes.

9. Limitation of Liability

IN NO EVENT SHALL PIPSCOMPUTERS PTY LTD, ICESHARE, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY:

INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES
DAMAGES RESULTING FROM YOUR USE OR INABILITY TO USE THE SERVICE
UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR DATA
CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATING TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US (IF ANY) IN THE PAST 12 MONTHS.

10. Indemnification

You agree to defend, indemnify, and hold harmless PIPSCOMPUTERS PTY LTD, ICEShare, and their employees, contractors, agents, officers, and directors from any claims, damages, obligations, losses, liabilities, costs, or debt arising from:

Your use of the Service
Your violation of these Terms
Your violation of any third-party rights
Any information you share through the Service

11. Termination

We reserve the right to terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will immediately cease.

Service Discontinuation: As a personal project, this service may be discontinued at any time. We will make reasonable efforts to provide notice, but cannot guarantee advanced warning.

12. Rate Limiting and Abuse Prevention

We implement rate limiting to prevent abuse. Excessive use may result in temporary or permanent blocking. We reserve the right to block IP addresses that engage in abusive behavior.

13. Advertising

This site may display advertisements via Google AdSense. We have no control over the specific ads shown. Ad revenue helps support hosting costs for this personal project.

14. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice via email (if we have your email) or on the website. Continued use of the Service after changes constitutes acceptance of the new terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Australia (specifically the state/territory where PIPSCOMPUTERS PTY LTD is registered), without regard to its conflict of law provisions.

16. Dispute Resolution

Any disputes arising out of or relating to these Terms or the Service shall first be attempted to be resolved through good faith negotiation. If negotiation fails, disputes may be resolved through binding arbitration in accordance with Australian law.

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the remaining Terms will otherwise remain in full force and effect.

18. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and PIPSCOMPUTERS PTY LTD / ICEShare regarding the Service and supersede all prior agreements.
